N10bn Libel Suit: Gov Ortom Gives Condition To Forgive Oshiomhole

Ortom has made it clear he will forgive Oshiomhole if he goes back to the news medium he used to vilify him and have the apology published and also meet conditions set by his (Ortom) lawyers.

The Governor of Benue State, Samuel Ortom, has said he is ready to forgive the former National Chairman of the All Progressives Congress (APC), if he tenders an apology.

Ortom stated this on Wednesday, while speaking to newsmen during the distribution of 46 vehicles to 23 local government chairmen and leaders of the State House of Assembly in Makurdi.

Newsflash247 had reported that the former National Chairman of the All Progressives Congress (APC), Comrade Adams Oshiomhole, on Tuesday, October 13, had begged the Benue State Governor, Samuel Ortom for out of court settlement in the N10 billion libel suit that was filed against him.

Governor Ortom had filed the libel suit against the former APC chairman over his comments against him in an APC sponsored press conference held in July 2018.

Oshiomhole had accused the north-central governor of having a hand in the death of two Catholic priests and other parishioners at Mbalom Community, Gwer East local government.

According to Oshiomhole during the press briefing, one of the priests had preached a ‘very critical sermon’ against the governor before that attack.

The attack on the parish had sparked outrage in the country especially among the Catholic community.

It also culminated in widespread protests by the Catholic faithful in Makurdi and the nation’s capital, Abuja.

It is believed that some killer herdsmen who had laid siege in Benue and perpetrated several havocs were responsible for the attack on the church.

Before the attack, Governor Ortom had been vocal about the presence of armed herdsmen in Benue communities, but he was largely ignored by federal authorities.

Oshiomhole in the early days of the suit had filed six preliminary objections all of which were resolved in favour of Governor Ortom by the court.

When the case resumed for definite hearing, counsel to Governor Ortom, Samuel Irabor told the court that he was ready to call his witnesses, but that Oshiomhole’s counsel had informed him earlier that they have considered putting up a retraction of the publication and that it would be ready within a week.

Ortom’s counsel explained further that it was based on that that he was applying for another date to take a look at the terms of settlement as canvassed by Oshiomhole.

On his part, Titus Akuhwa who held the brief of Oshiomole’s counsel, Festus Jumbo confirmed the submission of Governor Ortom’s lawyer.

“That is the true position of the matter. We have met and we are drawing out terms of settlement.

The Presiding judge, Justice Augustine Ityonyiman, after listening to both parties, adjourned the case to October 29, for report on the out-of-court settlement.

It would be recalled that Governor Ortom in the suit among other things, averred that Oshiomhole allegedly assassinated his character and damaged his reputation when in an APC sponsored press conference held on Friday July 27, 2018, he accused him of having a hand in the death of two Catholic priests and other parishioners at Mbalom community on the ground that one of the priests had preached a ‘very critical sermon’ against him (the Governor).

Some of the reliefs sought by Governor Ortom included the N10 billion suit against Oshiomhole include “a declaration by the court that the Defendants’ allegations and publication of July 27 against him are false, mischievous, unsubstantiated, defamatory and libelous.

“An order directing the defendants to publish simultaneous retractions/apologies in respect of the said libelous publication against him in the Sunday editions of 10 National Dailies circulating within Benue State as well as paid advertorials to the same effect on the prime time beats of the Nigerian Television Authority, Channels TV, TVC News, African Independent Television (AIT), Independent Television (ITV), Benin, Radio Nigeria, Radio Benue and Harvest FM.”

“An Order of Perpetual Injunction restraining the Defendants, their officers, privies, assigns, surrogates or agents whosoever called from further defaming and libeling the Plaintiff’s character and reputation and any other order(s) that the Court may deem fit to make in the circumstance.

In the reaction to governor Ortom said he is ready to forgive the former National Chairman of the All Progressives Congress (APC), if he tenders an apology.

“I am a Christian. The Bible says forgive us our trespasses as we forgive those who trespass against us.

“If he comes back now to tender an apology and also go back to the same news medium he used to scandalise and vilify me to have the apology published and also meet the condition set by my lawyers, I will certainly forgive him,” Ortom said.
