Atiku Urges Tribunal to Recognize His Victory, Claims He Won in 21 States

Former Vice President Atiku Abubakar has urged the Presidential Election Petition Court (PEPC) to recognize his victory in the 2023 presidential election, claiming he won in 21 states.

In his final written address to the PEPC, Atiku’s legal team argued that the Independent National Electoral Commission (INEC) admitted that Atiku won in 21 states in its response to Atiku’s petition challenging the election of President Bola Tinubu.

Atiku’s team pointed to paragraph 18 of INEC’s reply to the petition, which states that “the 1st Respondent further avers that in compliance with extant laws and regulations, it diligently discharged its duties when it collated the 1st Petitioner’s scores at the election which aggregates to 6,984,520 winning only 21 States to wit: Adamawa, Akwa Ibom. Bauchi. Bavelsa. Borno, Delta, Ekiti, Gombe, Jigawa, Kaduna, Katsina. Kebbi. Kogi. Kwara, Nasarawa, Niger, Osun, Sokoto, Taraba, Yobe and Zamfara.”

Atiku’s team argued that INEC’s admission in paragraph 18 is an admission against interest, which means that INEC cannot later deny it. They also argued that INEC’s failure to refute Atiku’s claim of victory in 21 states throughout the trial is an admission of its validity.

Atiku’s team is asking the PEPC to declare Atiku the winner of the 2023 presidential election and order INEC to issue him a certificate of return.
