Supreme Court Sets Date For Final Judgement In Nnamdi Kanu Case

The fate of the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, who is facing treasonable felony charges, will be determined by the Supreme Court on December 15, 2023.

The apex court announced the date on Thursday after hearing the final arguments from the lawyers of the federal government and Kanu.

The federal government, represented by Tijani Gazali (SAN), is seeking to overturn the ruling of the Court of Appeal that ordered Kanu’s release from detention and quashed the 15-count terrorism charge against him. The government argued that Kanu was lawfully repatriated from Kenya to continue his trial in Nigeria after he jumped bail.

However, Kanu, represented by Mike Ozekhome (SAN), is urging the Supreme Court to uphold the ruling of the appellate court that granted him his freedom and set aside the stay of execution on the judgment. Kanu contended that he was unlawfully abducted from Kenya and brought back to Nigeria in violation of his fundamental rights.

Newsflash Nigeria reports that a three-member panel of the Court of Appeal had delivered a unanimous judgment on October 13, 2022, in favour of Kanu. The appellate court held that the government displayed arbitrary use of power by forcefully repatriating Kanu from Kenya to continue his case in Nigeria.

A five-member panel of the Supreme Court, headed by Justice Kudirat Kekere-Ekun, will give its verdict on December 15, after considering the submissions of both parties. The judgment will have far-reaching implications for the future of democracy and rule of law in Nigeria.
