Court Stops NLC, TUC from Going on Strike over Fuel Price Hike

The National Industrial Court has issued an order to prevent the Nigeria Labour Congress (NLC), Trade Union Congress (TUC), and their affiliates from carrying out any strike or industrial action over the increase in fuel price.

The court granted the order on Friday, following an ex-parte application filed by the Federal Government and the Attorney General of the Federation (AGF).

The court, presided over by Justice Benedict Bakwaph Kanyip, relied on sections 17 and 19 of the National Industrial Court Act to restrain the organised labour from proceeding with their planned nationwide strike, which was scheduled to start on November 14.

The court held that the strike would cause severe hardship and disruption to the public and the economy.

The Federal Government and the AGF, represented by Tijani Gazali, a Senior Advocate of Nigeria (SAN) and Director of Civil Appeals in the Federal Ministry of Justice, argued that the strike would pose a threat to peace and security in the country. They cited the example of how the labour unions blocked the entrances to the major airports in the country on Thursday, causing inconvenience and distress to travellers and businesses.

The court agreed with the government’s submissions and granted all their prayers as contained in the motion paper. The court also ordered that the restraining order be pasted on the wall of the building at the last known address of the two defendants to notify them of the court’s decision. The court further ordered that the order and the originating and other processes be served by publication in two major national newspapers.

The case file has been transferred to Justice Olufunke Anuwe, who is said to be handling similar labour dispute related matters.
