Atiku Challenges Tribunal’s Verdict, Asks Supreme Court To Nullify Tinubu’s Election

The Peoples Democratic Party (PDP) presidential candidate, Alhaji Abubakar Atiku, has filed a notice of appeal at the Supreme Court, seeking to overturn the judgement of the Presidential Election Petition Court (PEPC) that affirmed the victory of Bola Ahmed Tinubu in the 2023 presidential election.

Atiku, through his lead counsel, Chief Chris Uche, SAN, based his appeal on 35 grounds, alleging that the tribunal, led by Justice Haruna Simon Tsammani, committed grave error and miscarriage of justice in its findings and conclusion in the petition challenging the declaration of Tinubu as President by the Independent National Electoral Commission (INEC).

Atiku argued that the tribunal failed to consider the evidence and arguments he presented to prove that the presidential election held on February 25, 2023, was marred by irregularities and non-compliance with the Electoral Act, 2022.

He claimed that INEC conducted the election based on false and misleading information contrary to the principles of the Electoral Act 2022 and the “doctrine of legitimate expectation”.

Atiku is praying the Supreme Court to set aside the whole findings and conclusions of the tribunal and nullify Tinubu’s election.

He is also seeking an order for a fresh election to be conducted in accordance with the provisions of the Electoral Act 2022.
