Supreme Court set to hear Ihedioha, Lyon appeals

The Supreme Court has fixed Tuesday, February 18, for hearing of the application filed by the former Imo State governor, Emeka Ihedioha, and the former Bayelsa governor-elect, David Lyon.

Recall that, Supreme Court had on January sacked Rt (Hon) Emeka Ihedioha of the Peoples Democratic Party, PDP as Imo State governor and declared Senator Hope Uzodinma, candidate of the All Progressives Congress (APC), as the duly elected governor of the state on the grounds that results from 388 polling units were excluded when the Independent National Electoral Commission (INEC) announced the final tally in March 2019.

Also, In the case of Baysela, David Lyon was sacked because Degi-Eremieoyo, his running mate, forged certificate and ordered for the withdrawal of his Certificate of Return and issuance of same to Douye who came second in November polls.

The apex court in a unanimous decision by a five-man panel of Justices led by Justice Mary Odili held that Degi-Eremieoyo presented forged certificates to the Independent National Electoral Commission (INEC).

The apex court upheld the November 12, 2019, judgement of a Federal High Court in Abuja, disqualifying Degi-Eremieoyo from participating in the governorship poll.

The apex court, in a unanimous judgment, declared Sen. Douye Diri of Peoples Democratic Party (PDP) the winner of the November 16, 2019 governorship election after it ruled that he scored the second-highest number of votes and had the required spread.

The spokesman of the Supreme Court, Festus Akande, said the appeals of both Imo and Bayelsa States will be held on Tuesday, February 18, TheCable reports.

“Yes it is true. The appeal of Baysela will also be held that day (Tuesday),” he said over the phone.
