How Obi Hopes to Overturn Tinubu’s Election with 50 Witnesses and Electronic Evidence
The legal battle between the President-elect, Bola Tinubu of the All Progressives Congress (APC) and his challenger, Peter Obi of the Labour Party (LP) over the outcome of the February 25, 2023 presidential election has been put on hold till Monday.
The presidential election petition tribunal sitting at the Court of Appeal in Abuja adjourned the case on Saturday after hearing from the lawyers of both parties.
The five-member tribunal headed by Justice Haruna Tsammani will resume hearing on Monday, 22nd May, 2023.
Peter Obi and the LP are contesting the victory of Tinubu and the APC in the election, alleging that it was marred by irregularities and fraud.
They have filed a petition seeking to nullify Tinubu’s election and declare Obi as the winner or order a fresh election.
To prove their case, they plan to call 50 witnesses who will testify for 30 minutes each in court. They will also present electronic evidence to support their claims.
Their lawyer, Awa Kalu (SAN) disclosed this during the pre-hearing session on Saturday.
Tinubu and the APC have denied any wrongdoing and urged the tribunal to dismiss the petition for lack of merit.
Their lawyer, Wole Olanipekun (SAN) argued that Obi and the LP failed to establish any prima facie case against Tinubu’s election.
He also challenged the competence of some of the witnesses and evidence listed by Obi and the LP.
The tribunal will decide on these issues when it resumes hearing on Monday.
