Court Strikes Out Suit Challenging Ekwunife’s Nomination As PDP Candidate
A Federal High Court sitting in Abuja has struck out a case before it challenging the nomination of Senator Uche Ekwunife as the Candidate of the People’s Democratic Party in the recently conducted Anambra Central Senatorial election.
The Plantiff, Mr Ifeanyi Francis Udechukwu approached the court seeking to nullify the Candidacy of Senator Ekwunife.
Delivering the judgment on Friday, the presiding Judge, Justice Okon Abang described the plantiff as a meddlesome interloper and a busy body. The Judge read that the plantiff lacks the locus standi to institute the case.
Speaking further, Justice Abang affirmed that the plantiff’s action is statute barred having been filed out of time.
“Both the PDP constitution and the electoral guidelines allow a party to withdraw and substitute a candidate”, he held.
The
court further held that the plantiff’s commencement of the action is
repugnant to the PDP constitution and affirmed that Senator Uche
Ekwunife’s nomination was done in compliance with the PDP’s constitution
and the electoral act.
