Court Sets Aside Garnishee Order On Ekiti State Bank Accounts

The Federal High Court Sitting in Lagos has set aside the Order Nisi which it granted in March 2019 to garnishee some bank accounts of the Ekiti State Government Funds.

The Court had granted the Order at the instance of some local government chairmen and councilors who were illegally sacked by the state Government in 2010.

The sacked local government officials through their counsel, Chino Obiagwu, SAN, obtained the Order Nisi while seeking to be paid the remainder of their emolument for the term in office, a period of 15months.

In his judgment on Monday, Justice Nicholas Oweibo discharged the Order Nisi following an application filed and argued by the Ekiti State Attorney General, Olawale Fapohunda on the 4th of May.

The Attorney General had argued that the Order Nisi was obtained upon a false representation on the part of the local government chairman and it has created a situation which is strangling the economy of the state.

In 2013, the Supreme Court delivered judgment in favour of the 16 local govt chairmen summarily dismissed and one of the orders it made was that they should be paid their outstanding emolument.

To compel the state government to pay, the 16 local government chairmen filed a suit at the Federal High Court, Lagos.

The court subsequently granted an Order Nisi garnishing the state funds in the Central Bank of Nigeria and 17 other commercial banks.

With today’s judgment, the Order Nisi has been set aside.
