Court Ruling: APM’s Petition Against Tinubu’s Election Dismissed

President Bola Tinubu and his Vice President, Kashim Shettima, have secured a legal victory as the Presidential Election Petition Court (PEPC) dismissed the petition filed by the Allied Peoples Movement (APM) to challenge their election. The court ruled that the petition lacked merit and was incompetent.

The APM had sought to nullify Tinubu’s election on the grounds that he was not qualified to contest the presidential election and that his vice, Shettima, was nominated twice by the All Progressives Congress (APC). The APM also accused the Independent National Electoral Commission (INEC) and four others of irregularities and malpractices in the conduct of the election.

However, the court, presided over by Justice Haruna Tsammani, rejected all the arguments of the APM and upheld the preliminary objections raised by the respondents. The court held that the issues raised by the APM were pre-election matters that should have been filed at the Federal High Court within 14 days after Tinubu was nominated by the APC.

The court also held that the APM had no locus standi to challenge Tinubu’s nomination and that the law did not permit a political party to question the nomination process of another party. The court further held that invalid nomination or double nomination was not a ground for disqualification under sections 131 and 137 of the Constitution.

Newsflash Nigeria reports that the APM had asked the court to invalidate Tinubu’s votes because Shettima was a senatorial candidate in Borno State when he became Tinubu’s running mate. The APM only called one witness to support its case, which was closed on June 21.
