Court orders INEC to issue certificate of return to APC House of Reps candidate

The appeal court sitting in Enugu has ordered the Independent National Electoral Commission (INEC) to issue certificate of return to Comrade Chinedu Ogah of the All Progressives Congress (APC).

The court which was led by Justice Ignatius Agube, gave the order following a judgement issued by the election petition tribunal in Abakiliki.

According to Daily Trust, the tribunal had declared the candidate of the APC as the authentic winner of the February 23, 2019 poll for Ikwo/ Ezza South federal constituency, and also ordered for the withdrawal of the certificate from the candidate of the Peoples Democratic Party (PDP).

Recall that Hon. Lazarus Ogbee of the Peoples Democratic Party, (PDP) had approached the appeal court, urging it to set aside the judgement of the Elections Petition Tribunal in Abakiliki which directed the withdrawal of his certificate as the winner of the election in favour of Comrade Ogah, who INEC declared second in the race.

In the same vein, the appeal court upheld the election of Hon. Sylvester Ogbaga of the PDP representing Izzi/Abakiliki Constituency at the House of Representative.

This was contained in suit CA/E/EAPP/17/2019, filed by the candidate of the APC, Hon. Maurice Uchenna Nshii.

Hon. Ogbaga is at the National Assembly for the fourth time and is the only person to have reach that height in Ebonyi State.

Meanwhile, Newsflash247 also reported that Appeal court sitting in Ado Ekiti will deliver the judgment on Wednesday, November 6, 2019 between Senator Biodun Olujimi of the Peoples Democratic Party senatorial candidate and Prince Dayo Adeyeye of the All Progressives Congress, APC.

Adeyeye filed 19 ground appeals against the September 10, 2019 judgment of an election petitions tribunal which declared former minority leader , Biodun Olujimi as the Ekiti South senatorial winner.

The 19-ground appeals were filed by Adeyeye to challenge the verdict of the Ekiti State National Assembly Election Tribunal delivered on September 10.

The three-member panel of the Tribunal led by Justice Danladi Adeck, in a judgment delivered on 10th September, 2019, ordered INEC to withdraw the Certificate of Return given to Adeyeye and issue a fresh one to Olujimi.

The panel upheld Olujimi’s averments that there was no proper accreditation, there was no proper account of ballots and that the number of votes or ballots recorded is more or less than the number of accredited voters, among others.

After the Tribunal deducted votes from what the two parties scored at the election, PDP was left with 54,894 and APC was credited with 52,243.

Adeyeye prayed the appellate court “to allow the appeal and set aside the declaration and return of Olujimi.”

The Senate spokesman urged the Court of Appeal to affirm his declaration and return by the Independent National Electoral Commission (INEC) as the winner of the senatorial poll held in the district on February 23.

While Adeyeye ran on the platform of the All Progressives Congress (APC), Olujimi, the immediate past Senate Minority Leader sought re-election on the platform of the People’s Democratic Party (PDP).
