Court Dismisses Suit by Governor Akeredolu, Ondo Lawmakers Against Deputy Governor

The Ondo State High Court in Akure has dismissed a suit filed by the Ondo State Government and Governor Rotimi Akeredolu against the Deputy Governor of the state, Lucky Aiyedatiwa, and some officials of the High Court, the House of Assembly, the Speaker of the House and the Chief Judge of Ondo State.

The suit was filed to challenge the procedure of settlement and compilation of records of appeal for the hearing of the appeal filed by the deputy governor.

The claimants, through their counsel, sought to withdraw the suit on Monday, claiming that events had overtaken the suit. However, the deputy governor’s counsel, Mr Ebun-Olu Adegboruwa (SAN), objected to the oral application, arguing that the issues had been joined by filing a defence and a counter-claim.

Justice D.I. Kolawole, in his ruling, struck out the suit, stating that the rules of the court allowed the claimants to withdraw the suit. He also directed all the parties to maintain the peace and adjourned the case till November 22, 2023, for hearing of applications.

The deputy governor had filed an appeal against the decision of the House of Assembly to impeach him over allegations of gross misconduct.

The impeachment process was halted by the High Court, which granted an interim injunction restraining the House of Assembly from taking any further action against the deputy governor.

The deputy governor’s appeal is one of the issues that have strained the relationship between him and the governor, who belong to the same party, the All Progressives Congress (APC).

The Speaker of the House of Assembly, Mr Olamide Oladiji, had recently said that the deputy governor needed to withdraw the cases in court before any reconciliation could take place.

He said the deputy governor was the one who took them to court and that they could not reconcile themselves when they had cases in court.
