APC Suffers Defeat As Appeal Court Sacks Senator, Reps Member

The Appeal Court sitting on Friday, November 15, in Sokoto State has dismissed the suit by candidates of the All Progressives Congress (APC) seeking to set aside its earlier judgement declaring Ibrahim Danbaba and Balarabe Kakale as Senator and House of Representative member in the National Assembly respectively.

The presiding judge, Justice Ibrahim Musa Saulawa, says the Court of Appeal lacks the jurisdiction to entertain the application filed by Senator Abubakar Shehu Tambuwal and Aliyu Shehu AA who were sacked by the appellate court on October 30.

According to Daily Trust reports that the presiding judge, Justice Ibrahim Musa Saulawa, while delivering a verdict on the suit filed by Senator Abubakar Shehu Tambuwal and Aliyu Shehu AA who were sacked by the appellate court on October 30, ruled that the court lacked jurisdiction to entertain the application.

The Court of Appeal also awarded the sum of N50,000 cost against the applicants.

Meanwhile, Newsflash247 had earlier reported that the Court of Appeal sitting in Abuja has cleared the APC to participate in the November 16 governorship election in Bayelsa state.

According to the Minister of State for Petroleum, Mr Timipre Sylva, who made the statement on Thursday said the Appeal court in Abuja has granted the APC a stay of execution on the judgment delivered by the Federal High Court, nullifying the primaries of the party.

Newsflash247 reported that the Federal High Court sitting in Bayelsa on Thursday voided the direct primary conducted by the APC that produced Mr David Lyon as the governorship candidate of the party.

Senator Heineken Lokpobiri, former Minister of State for Agriculture, had dragged APC to court over alleged irregularities during a direct primary conducted by the party on September.

Reacting, Sylva, who disclosed the Appeal Court’s decision in a news confrerence in Yenagoa on Thursday, said that the APC would fully participate in the Saturday governorship poll.

“I must tell you that the judgment nullifying the primary was clearly a biased one with all due respect to the judiciary.

“So, I have come to address you because we have good news for the people of Baylesa. The court in Abuja has granted us stay of execution.

“That means, we are fully as a party in the position of contesting this election.

“Because we know that the people of Baylesa are seriously behind us and we will win the election.

“Everyone in Bayelsa knows that APC has the majority in the state and if there is an election today, it is clear even to blind and the deaf that APC will win.

“The electorate should go en-masse and vote the candidature of the APC, Mr David Lyon,” NAN quoted the minister as saying.
