2023: Court stops Senator Abbo from contesting senatorial election over against Muslim-Muslim ticket

The Federal High Court in Yola, Adamawa State, has ordered the withdrawal of the Adamawa North senatorial ticket of Ishaku Elisha Abbo over his position against the Muslim-Muslim presidential ticket of the All Progressives Congress (APC).

The Court also restrained the All Progressives Congress, APC, from recognising him as such.

The judgement was delivered on Tuesday by Justice Danladi Mohammed. Justice Danladi ruled that Senator Abbo was not qualified to seek re-election since the party had expelled him.

Recall that Senator Abbo was expelled from the APC in October 2022, which was instigated by members of the APC in Mubi North LGA, over his opposition to the party’s Muslim-Muslim ticket of Bola Tinubu and Kashim Shettima.

Justice Danladi based his judgement on the October 2022 resolution of the ruling party in the northeastern state.

The Judge held that the Senator and the APC are bound by the resolution of Mubi North Local Government executives of the party dated 7th October 2022, which expelled the lawmaker; thus he is not entitled to enjoy any right or privilege accorded to APC members.

Justice Danladi held that the plaintiff’s counsel had proved beyond doubt and that the court was satisfied with the procedure followed by the party, saying that Mr Abbo was accorded the opportunity to defend himself but refused to so do.

The court, therefore, restrained Mr Abbo from parading himself as the candidate of the party.

The plaintiff’s counsel, Abubakar Ali, praised the court’s decision, saying that such punishment will serve as a deterrent to other party members.

Meanwhile, the embattled Senator has faulted the ruling, describing it as a cash-and-carry judgement.
